Triathlon.org (hereinafter “the Site”) is part of the World Triathlon which operates and manages this sector. By using the Site you (hereinafter “the User”) agree to be legally bound by these terms and conditions. If you do not agree to be legally bound by all the following terms you should not access and/or use triathlon.org.

World Triathlon reserves the right to change these terms from time to time. By continuing to use the Site after changes are posted, the User agrees to be legally bound by these terms as updated and/or amended.

All copyright and all other intellectual property rights in all text e.g.(press releases, datasheets, stats etc), images e.g.(photographs, graphics, logos, service marks, video etc), sound, webcasts and other materials (hereinafter “the Content”) on the pages of the Site are owned by World Triathlon and affiliated organisations or are reproduced on the Site with the permissions of the relevant rights owner.

The Content of the Site may not be copied, reproduced, distributed, republished, downloaded, displayed, posted or transmitted in any form or by any means without World Triathlon’s prior written consent, except as stated below:

The User may read, view, print and download the Content of an individual page for private and personal non-commercial use only provided that all copyright, trademarks and other proprietary notices contained in the original materials on any copy of these materials are retained, but you may not make more than one copy electronically or otherwise of any of the Content and you may not recopy or further distribute, sell, publish or transmit any part of the material by electronic or any other means.

The User agrees not to sell, resell, supply or otherwise make the Content or extracts or other information derived therefrom available in any manner or on any media to any third party without the prior written consent of World Triathlon.

The User acknowledges that “World Triathlon”, “triathlon.org”, World Triathlon Championship Series” are trademarks which are owned by the World Triathlon.

The User agrees not to use the Site for any purpose that is unlawful. The User shall not use the Site in any manner which could damage, disable, overburden, or impair the Site or interfere with any other party’s use and enjoyment of the Site or its associated services. The User may not obtain or attempt to obtain any materials or information through any means not intentionally made available or provided for through the Site.

The Content is provided on an “AS IS” and on an “AS AVAILABLE” basis without any representations or any kind of warranty whether express, implied or statutory of merchantability, fitness for a particular purpose, non-infringement, compatibility, security and accuracy.

World Triathlon shall not be liable for any damages, including indirect or consequential damages, or any damages arising from use or loss of use, interruption of business, loss of data or profits, whether in contract, negligence or other tortious action, arising from or in connection with the use of triathlon.org

World Triathlon does not warrant that functions contained in triathlon.org content will be uninterrupted or error-free, that defects will be corrected, or that triathlon.org or the server that makes it available are free of viruses or bugs.

The User shall pay all costs and charges, including phone charges and telecommunications equipment costs, that the User incurs in order to access or use the Site, Services and Content. The User must adhere to all limitations on dissemination, usage and reproduction of any of the Content that the User downloads from the Site that are subject to such limitations. The User agrees to use the Services only to access, download, utilize, post, send or receive the Content in an appropriate manner as related to the particular Content or Services being accessed or used by the User.

If the User is required to establish an account / provide information in connection with a particular Service or Content, the User shall complete the designated registration process for such Service or Content. All required registration information that the User provides must be current, complete and accurate and kept up to date on a prompt, timely basis. If required, the User must also choose a user name and password for such an account. It is the User’s sole responsibility to keep the account number, user name, password and other sensitive information confidential.

Content and Services provided by third parties (collectively, the “Third-Party Services”) are governed by separate agreements accompanying such Content and Services. World Triathlon offers no guarantees and assumes no responsibility or liability of any type with respect to the Third-Party Services, including any liability resulting from incompatibility between a Third-Party Service, World Triathlon Content, World Triathlon provided Services or another Third-Party Service. The User agrees that they will not hold World Triathlon responsible or liable with respect to the Third-Party Services.

The User is entirely responsible for maintaining the confidentiality of the User’s password and account, and for any and all activities which occur under the User’s account or password. The User agrees to immediately notify World Triathlon of any unauthorized use of the User’s account, password, or any other breach of security known to the User. World Triathlon will not be liable for any loss that the User may incur as a result of someone else using or accessing the User’s password or account, either with or without the User’s knowledge. However, the User may be held liable for losses incurred by World Triathlon or any other party as a result of someone else using or accessing the User’s password or account. The User shall not use anyone else’s account at any time without the permission of the account holder. The User may change his/her password or profile by following instructions on the Site.

World Triathlon will use and protect the User’s data, such as the name and address, in accordance with the World Triathlon Privacy Policy, the contents of which are incorporated by reference into the Terms of Use. Please be aware that the Users browser must be enabled to accept cookies in order for you to use certain Content and Services or to purchase from the World Triathlon online store. The Privacy Policy Statement does not apply to Third-Party Sites.

API & RSS feeds of World Triathlon Content are provided free of charge to individuals for personal and non-commercial use only. Use of World Triathlon API or RSS feeds for commercial purposes or by non-profit organizations will require the prior agreement of World Triathlon. The User must first contact the Head of Technology. By using a World Triathlon API or RSS feed, you acknowledge that World Triathlon does not accept any liability for its API or RSS feeds and that World Triathlon is not responsible for the content of external Internet sites.

World Triathlon is not responsible for the availability or content of any third-party websites or material accessed through the Site. World Triathlon does not exercise any control or supervision of the content of these linked sites.

World Triathlon does not endorse, and shall not be held responsible for any content, advertising, products, services or information on or available from third-party sites. Third-party sites linked through the Site are not covered by these terms and conditions.
